On Monday morning, the Commissioner of Justice heard a petition from Otmar Oduber and in the afternoon a decision was made. Otmar Oduber asked the Judge Commissioner to set a period within which the Prosecutor must decide whether to take the case to the Flamingo Court or to dismiss the case, as has been done with several cases lately.
On Monday afternoon Otmar Oduber was informed that his request was unfortunately denied. This is because even if the criminal case is clear, the prosecutor still needs time to study it properly. And after studying it thoroughly, he still needs time to write a citation that meets all the requirements of the law.
To arrive at the above mentioned point sufficient time to do this work is necessary. And the Commissioner said that a decision that is too simple can have serious consequences.
One of the issues he also mentioned is that in the Caribbean, taxpayers change regularly when their contracts expire. It’s a situation that has always existed. This case was thrown into the hands of a new prosecutor who had no prior knowledge of the Flamingo case.
He also mentioned that it was not proven that the prosecutor did nothing with the Flamingo case, which could have been the reason for setting a deadline to force OM to move and work.
This means that the prosecutor has time to continue studying the case even though the criminal case has been closed since January and has not been able to reach a decision even if Otmar Oduber is brought to court.
